Anoki Inc. (“Anoki,” “we,” “us,” “our”) enables certain personalization functionality on your TV and provides a free, personalized, ad-supported TV service giving viewers access to a wide variety of content (collectively, the “Anoki service,” “our service,” or “the service”). This Privacy Policy describes how we collect and process your personal information through the Anoki service. By using our service, you are consenting to the practices described in this Privacy Policy.

INFORMATION WE COLLECT, GENERALLY: 

We collect information to offer personalized experiences for you, to improve the service for you and others, and, to support our free offerings to you, to show you advertisements that may be relevant for you. We may also receive information about you from third parties and from the devices you use with our service. The information we collect includes:

Information You Give Us: We receive and store any information you provide directly to us when you use our service, including but not limited to ratings you offer, viewing preferences you identify, and, depending on the platform you use, your account settings.

Automatic Information: Our service can automatically collect and store certain types of information, including:

  • your activity on our service, such as your content selections, the shows you watch, the advertisements you see, and your search history.
  • Information about how you interact with our marketing messaging and emails and the advertisements shown to you.
  • Device information, such as device IDs or other unique identifiers and the type of device you use to access our service (e.g. mobile device, laptop, smart TV), and networking configurations and devices (like your router).
  • The IP address associated with your access to our service, which can be used to tell us your general location, such as your city, state/province, and postal code.

  • Information from Other Sources: We may also receive information that may pertain to you from third parties such as:
  • device providers who make our service available on their devices.
  • service providers who help us determine a location based on your IP address in order to customize our service, enforce media digital rights, and ensure data security.
  • security service providers that help us protect our systems.
  • advertisers and their service providers who facilitate the sale, delivery, operation, and management of advertisements, and advertising measurement companies (“Ad Measurement Companies”).
  • social media platforms and public databases associating IP addresses with internet service providers (ISPs).

VIEWING INFORMATION SERVICE

On Smart TVs, our service includes "Automatic Content Recognition" or “ACR”. When you enable ACR, you enable us to better personalize your experience on the Smart TV with your Viewing Information which includes information about shows you watch, advertisements and other publicly available content displayed through the Smart TV, and unique identifiers about your Smart TV, including the IP Address, the TV source you are using (e.g., HDMI), the settings on your TV (e.g., language), and the geographical location such as city, state, and country where the TV is located. The Viewing Information also includes information about your use of our streaming applications and is sometimes enhanced with household demographic data and other data associated with an IP address. 

What do we do with it?

Anoki may use Viewing Information to:

  • Provide content personalization and recommendation of content
  • Generate summary analysis and reports on how users engage with content and our service
  • Tailor advertising content you may see
  • Measure success of advertising campaigns and otherwise support our marketing efforts
  • Share with our authorized third parties 
  • Improve the type of advertising for features, products, and services that might be of interest to you

What does this mean for you?

In addition to providing you with better content personalization and recommendation on our service, use of Viewing Information also enables Anoki and its authorized partners to deliver advertising that Is relevant to your profile and that you might find useful, both on the device on which you use our service and any other of your devices that shares the same IP address. It is also used to help content publishers, broadcasters, or content distributors to create or recommend more relevant content based on insights and reports derived from that information. 

How do you opt out of ACR?

Depending on your TV version, you can either go to the “Google TV Settings – Privacy – Anoki Viewing Information Service” page or to the “Android TV Settings – Device preferences – About - Legal information – Anoki Viewing Information Service” page to opt out of the Service. You can also follow your TV instructions to reset the TV back to its Factory Settings.

ADDITIONAL USES OF YOUR INFORMATION

In addition to the use of Viewing Information described above, we may use your personal information to operate, provide, develop, and improve our products and services, such as to:

  • Provide, troubleshoot, and improve our service. For example, we may use your personal information to analyze and understand our audience, provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of our applications.
  • Provide localized content using your geographic location (such as your city, state/province, and postal code).
  • Secure our systems and prevent fraud.
  • Communicate with you. Depending on the platform that you use and your choices, and where we have collected contact information from you, we may use that information to communicate with you, but we will provide opt out mechanisms for your receipt of those communications as required by applicable law.
  • For your mobile devices, we may send push notifications or alerts to your mobile device. You can deactivate push notifications by changing the notification settings on your mobile device.

INFORMATION SHARING

We disclose your information to third parties as described below and subject to this Privacy Policy:

  • Service Providers: We use other companies, agents or contractors ("Service Providers") to perform services on our behalf or to assist us with the provision of services to you. For example, we engage Service Providers to provide marketing, advertising, communications, security, infrastructure and IT services, to customize, personalize and optimize our service, to provide customer service, to analyze and enhance information (including information about users' interactions with our service), and to process and administer consumer surveys. 
  • Advertisers/Ad Measurement Companies: We may share information collected from or about you with advertisers and/or ad measurement companies (“Ad Partners”) to select advertisements, and measure and improve advertising effectiveness. 
  • Protection of Anoki and others: Anoki and its Service Providers and Ad Partners may disclose and otherwise use your personal and other information where we or they reasonably believe such disclosure is needed to (a) satisfy any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms of service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address illegal or suspected illegal activities (including digital rights infringement), security or technical issues, or (d) protect against harm to the rights, property or safety of Anoki, its users or the public, as required or permitted by law.
  • Business transfers: In connection with any reorganization, restructuring, merger or sale, or other transfer of assets by Anoki, we will transfer information, including personal information, provided that the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Policy.

YOUR CHOICES

Data Subject Requests

Subject to applicable law and to the extent applicable to our service, you may:

  • request access to, or correction or deletion of, the personal information we maintain about you.
  • opt out of the (a) sharing of your personal information for cross-context behavioral advertising purposes, or (B) processing of your personal information for targeted advertising purposes. 
  • In addition, subject to applicable law, you may receive certain of your personal information that you have provided to us. 

To submit a request, please email privacy@anoki.ai. Please note that depending on how you make your request, we may need to verify your identity and that of any agent you’ve authorized. Also, please note that you must separately opt out of sharing viewing information for the ACR service and for targeting advertising on our viewing application, Live TVX; opting out of one does not automatically opt you out of the other.

Anoki Viewing Information Service Opt-out:

Anoki Live TVX Targeted Ads Opt-out:

To opt out of targeting advertising on our Live TVX viewing application, please go to the "Anoki Live TVX App Settings - Ads" section to choose if ads can be personalized on the Live TVX Service based on the device’s advertising ID. You will have the option to reset or delete your device's advertising ID.

Anoki is not a member of any self-regulatory bodies for interest-based advertising like the DAA and NAI, but some of our Advertising Partners and Service Providers are members of self-regulatory bodies and require that we provide you with the following out links to the NAI and DAA opt out programs: for the NAI, see https://www.networkadvertising.org/choices, and for the DAA, see https://www.aboutads.info.

COOKIES, TAGS, AND ANALYTICS

For our web-based offerings, we may use cookies and similar technologies, such as tracking pixels and analytics tools, (collectively, “Tags”) to collect additional usage information. Most browsers allow you to disable cookies or set your browser to alert you when cookies are being sent to your computer. We and our Service Providers use analytics tools (“Analytics Tools”) that use Tags to collect and analyze information about your use of our website. We use that information to monitor and improve our website and as provided above. CHILDREN

The Services are designed for use by adults (ages 18+). Accordingly, we do not knowingly collect or maintain personally identifiable information from persons under 18 years of age, and no part of the Services is directed to persons under 18. If we learn that we have collected personal information from a minor (under 18), then we will take the appropriate steps to delete such information.

RETENTION

We will retain your personal information for the time period reasonably necessary to achieve the purposes described in this Privacy Policy, or any other notice provided at the time of collection unless a longer retention period is required or permitted by applicable law.

SECURITY

Anoki takes appropriate steps to ensure data privacy and security through various hardware and software methodologies. However, we cannot ensure or warrant against all risks with regards to the security of that information, so information you choose to transmit to Anoki and which we store is provided to us at your own risk and Anoki does not guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our safeguards.

DO NOT TRACK

Currently, we do not respond to “Do Not Track” browser features, but we may do so in the future as industry standards evolve.

CHANGES TO THIS PRIVACY POLICY

We may change this Privacy Policy from time to time. If we do, we will post the changes on the Site and update the last updated date of this Privacy Policy.
