U.S. States Privacy Notice
Effective Date: May 25, 2024.
We’ve provided this Privacy Notice (“Notice”) to help residents of California, Colorado, Connecticut, Utah and Virginia, understand how Anoki, Inc. (“Anoki,” “we,” “us,” or “our”) collects and uses data and to inform them of the categories of data we collect, why we collect them, how we use them, and with whom we share them.
This Notice supplements our Privacy Policy. In the event of a conflict between any other policy, statement, or notice and this Notice, this Notice will prevail as to consumer rights under the applicable state privacy laws of the states noted above (“State Privacy Laws”).
Personal Information Collected and Disclosed
The Anoki service includes the provision of the Anoki Live TVx application and the use of automatic content recognition technology (“ACR”). Since we don’t require any registration for the Anoki service, we do not collect things like your name, your email address or your physical address in operation of our service. Instead, we collect information in order to bring you a personalized viewing experience, including:
- your activity on our service, such as your content selections, the shows you watch, the advertisements you see, and your search history.
- Information about how you interact with our marketing messaging and emails and the advertisements shown to you.
- Device information, such as device IDs or other unique identifiers and the type of device you use to access our service (e.g., mobile device, laptop, smart TV), and networking configurations and devices (like your router)
- The IP address associated with your access to our service, which can be used to tell us your general location, such as your city, state/province, and postal code.
Where you provide any ratings or reviews, or where you request customer support, we may collect your name, email address, and the information you elect to provide to us, and some of that information may qualify as sensitive data or sensitive personal information under State Privacy Laws; however, we don’t use such information for any purpose other than for the purpose for which you provided it to us, e.g. for customer support or for ratings and reviews.
The table below describes the categories of personal information we collect as well as examples of data within such categories, the processing purposes applicable to each category of personal information, and the categories of recipients that receive those specific categories of personal information. For recipients of that information, we’ve classified them as “Device Providers” who make the Anoki service available on their devices, “Service Providers” who provide us with various technologies and services that enable the operation of the Anoki service, and “Advertising Partners,” consisting of advertisers and related advertising service providers who facilitate the sale, delivery, operation, and management of advertisements, and advertising measurement companies.
Your Rights
You have the right to: (i) know what personal information we have collected about you, including sources, purpose of collection, and third parties we have shared it with; (ii) have us correct personal information; (iii) have us delete your personal information; and (iv) the right to opt out of collection of personal information, in addition to any other rights applicable under State Privacy Laws.
How to Opt Out of Targeted Advertising
To opt out of collection of personal information for targeted advertising, you can do two things. To opt out of ACR, depending on your TV version, you can either go to the “Google TV Settings – Privacy – Anoki Viewing Information Service” page or to the “Android TV Settings – Device preferences – About - Legal information – Anoki Viewing Information Service” page. You can also follow your TV instructions to reset the TV back to its Factory Settings. To opt out of targeting advertising on our Live TVx viewing application, please go to the "Anoki Live TVx App Settings - Ads" section to choose if ads can be personalized on the Live TVx Service based on the device’s advertising ID. You will have the option to reset or delete your device's advertising ID. Please note that you must separately opt out of sharing viewing information for the ACR service and for targeting advertising on our viewing application, Live TVx; opting out of one does not automatically opt you out of the other.
How to Make a Request Appeals
For other requests, please email privacy@anoki.tv. Depending on how you make your request and the type of request, we may need to verify your identity and that of any agent you’ve authorized. Please note that since we don’t require any registration, we may require that you verify your identity using information that we do collect and, where an agent is acting on your behalf, we may need to verify that you provided the agent permission to submit the request, including proof concerning his or her status as an authorized agent. In addition, we may require that you verify that you provided the agent permission to submit the request. If we cannot verify your identity, we may not be able to respond to your request. We will respond to your request consistent with applicable law. If we refuse to take action on your request, you may appeal this refusal within a reasonable period under applicable State Privacy laws after your receipt of the decision by submitting a request for appeal to privacy@anoki.tv.
Minors
The Anoki service is designed for use by adults (ages 18+). Accordingly, we do not knowingly collect or maintain personally identifiable information from persons under 18 years of age, and no part of the Anoki service is directed to persons under 18. If we learn that we have collected personal information from a minor (under 18), then we will take the appropriate steps to delete such information.
Notice of Financial Incentives
We do not offer financial incentives, including price or service differences, to consumers in exchange for the collection, retention, sale or sharing of their personal information.
De-Identified Information
Where we maintain or use de-identified data, we will continue to maintain and use the de-identified data only in a de-identified fashion and will not attempt to re-identify the data to a specific person.
Changes
We reserve the right to amend this Notice at our discretion and at any time. When we make changes to this Notice, we will post an updated version on the Anoki service and update the Effective Date (which will be the date that this Notice was last updated).
